These Terms govern your use of sairesaviation.com and the information and requests you submit through it. By using this website, you agree to them. If you do not agree, please do not use the site.
1. Who we are
Saires™ is a commercial brand and operating name representing Saires Services LLC (United States) and its affiliated entity Saires Aviation Services C.A. (Venezuela). Our specialized units (Saires Aircraft Management, Saires Jets, Saires Aircraft Sales, Saires Aircraft Parts and Saires Aviation) operate under this structure, and every service is arranged and executed by one of those two entities.
2. This website is information, not an offer
The content on this site is provided for general information. Aircraft availability, specifications, pricing and lead times change constantly and are not guaranteed. Nothing on this website is a binding offer, and no contract exists between us until it is agreed in writing.
3. Quotes and requests
When you submit a form, you are asking us for a quote or for information. A quote is an estimate based on what is available at that moment; it may change, and it becomes binding only when confirmed in a written charter agreement, purchase order or service agreement. You agree that the information you give us is accurate and that you are authorized to give it, including where it concerns other passengers.
4. Charter flights: we are a broker, not an air carrier
Saires acts solely as an air charter broker and is not a direct air carrier or a direct foreign air carrier in operational control of aircraft. All flights arranged, advertised or chartered through Saires are operated by properly licensed direct air carriers or direct foreign air carriers (under FAA Part 135, INAC RAV 135, or the equivalent rules of another civil aviation authority), and those carriers retain full operational control and safety oversight at all times. Operational decisions, including whether a flight departs, are made by the operating carrier and its pilot in command.
Before you enter into a charter contract, and as required by U.S. Department of Transportation regulations for air charter brokers, we will disclose in writing:
- the corporate name of the direct air carrier in operational control of the aircraft, and any other carrier that will operate part of the transportation;
- the capacity in which Saires is acting: as an agent of the charterer, as an agent of the operating carrier, or as an indirect air carrier;
- the total cost of the transportation, including any broker or carrier-imposed fees and government-imposed taxes and fees; and
- whether Saires holds liability insurance covering the charterer, passengers and property, and the monetary limits of that coverage.
On request, we will also tell you about any relationship between Saires and the carrier we select that could influence that selection, and about third-party fees such as fuel, landing or hangar charges. The carrier's own conditions of carriage apply to the flight itself.
5. Aircraft management, sales and trip support
Management, trip support and advisory services are provided under a separate written agreement that defines their scope. In aircraft sales transactions, specifications, logbooks, maintenance status and history are supplied by the owner or by third parties; we pass that information on in good faith but do not independently guarantee it, and we recommend an independent pre-purchase inspection and title search. Nothing on this site is investment, tax or legal advice.
6. Aircraft parts and export compliance
Parts are offered subject to availability and to the airworthiness documentation that applies to each item. Airworthiness determinations are made by the certified maintenance organization or authority responsible for the aircraft, not by this website. Sales and shipments of aircraft parts may be subject to U.S. export control laws, sanctions programs and the equivalent rules of other jurisdictions; both parties agree to comply with them, and we may decline or cancel a transaction that would breach them.
7. Acceptable use
You agree not to use this site to send false, misleading or unlawful information; to submit automated, bulk or spam requests; to attempt to gain unauthorized access to the site or its systems; or to copy, scrape or republish its content for a competing service.
8. Intellectual property
The Saires™ and Saires Jets™ names and logos, and the text, images and layout of this website, belong to Saires or to its licensors and may not be used without our written permission. Airport data used by the flight search comes from public sources, including OurAirports and OpenFlights, and is used under their respective licenses.
9. Third-party links
This site links to services operated by others, such as WhatsApp and Google Maps. We do not control them and are not responsible for their content or their privacy practices.
10. No warranty
This website is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the site will be uninterrupted, error-free or free of harmful components, or that the information on it is complete or current.
11. Limitation of liability
To the fullest extent permitted by law, Saires and its affiliates, officers, employees and agents will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost business or lost data, arising out of your use of this website. Because operating carriers hold operational control of every flight, Saires is not liable for their acts or omissions, including delays, diversions and cancellations, except to the extent the law provides otherwise or we have agreed otherwise in writing.
12. Indemnity
You agree to indemnify Saires against claims, losses and expenses arising from information you submit that is inaccurate or that you were not authorized to provide, and from your use of this website in breach of these Terms.
13. Privacy
Our Privacy Policy and Cookie Policy explain how we handle your information and form part of these Terms.
14. Changes to these Terms
We may update these Terms. The version in force is the one published on this page, with the date shown at the top. Continuing to use the site after a change means you accept the updated Terms.
15. Governing law
These Terms are governed by the laws of the State of Florida, United States, without regard to its conflict of laws rules, and the state and federal courts located in Palm Beach County, Florida will have exclusive jurisdiction over any dispute arising from them. Nothing here limits any right you may have to bring a claim before the authorities of your own country of residence where the law gives you that right.
